Planner Securities LLC – In the News:
FINRA v. Planner Securities LLC (Case #2017052478902) – During the period December 2015 to November 2018, Planner and Santos failed to establish and implement (i) an anti-money laundering (AML) compliance program reasonably designed to detect and cause the reporting of potentially suspicious transactions, and (ii) a reasonably designed Customer Identification Program (CIP). Santos delegated responsibility for virtually all of the firm’s AML program to the firm’s AML compliance officer (AMLCO), but he was aware that the firm’s AMLCO had not performed his AML responsibilities and did not take any action to address those failures. Santos was personally responsible for the firm’s CIP, but he failed to carry out his responsibilities. By reason of the foregoing, Planner and Santos violated FINRA Rules 3310(a), 3310(b), and 2010. During the period December 2015 to August 2017, the firm failed to establish and maintain a supervisory system, including written supervisory procedures, reasonably designed to achieve compliance with applicable securities laws and regulations and FINRA rules. As the firm’s business model changed starting in 2015, the firm did not establish procedures to supervise the new business lines, resulting in its failure to supervise transactions involving both options and equities, including a high percentage of equities trades in low-priced securities. By reason of the foregoing, Planner violated FINRA Rules 3110(a), 3110(b), and 2010. Planner failed to conduct testing of its supervisory control system for the year 2016 and failed to create a report documenting its process for establishing, maintaining, reviewing, testing and modifying the firm’s compliance policies. By reason of the foregoing, the firm violated FINRA Rules 3120, 3130, and 2010.
