FINRA v. Lampert Capital Markets Inc. (Case #2019061158901) – Between November 2018 and May 2019, Lampert Capital Markets misclassified certain non-allowable receivables as allowable assets and failed to deduct those receivables from its net worth in computing net capital. Consequently, the firm overstated its net capital during the period, and it operated a securities business on one day during the period while below its net capital requirement. As a result, the firm violated § 15(c) of the Securities Exchange Act of 1934, Exchange Act Rule 15c3-1, and FINRA Rules 4110(b)(1) and 2010. Relatedly, the firm maintained inaccurate books and records concerning its allowable assets and net capital and filed six inaccurate Financial and Operational Combined Uniform Single (FOCUS) reports during the same period. As a result, the firm violated Exchange Act § 17(a), Exchange Act Rules 17a-3 and 17a-5, and FINRA Rules 4511(a) and 2010. In addition, the firm failed to provide required notifications to FINRA and the SEC regarding its net capital levels on four occasions during the relevant period. As a result, the firm violated Exchange Act § 17(a), Exchange Act Rule 17a-11, and FINRA Rule 2010.
