FINRA v. South Street Securities LLC (Case #2016047737402) – From March 2014 to June 2016, South Street paid approximately $847,000 to an unregistered company (“Company A”) that one of South Street’s associated persons owned and controlled, in exchange for referrals of counterparties for repurchase and reverse repurchase transactions. South Street did not analyze whether those payments would require Company A to register as a broker-dealer. By doing so, South Street violated NASD Rule 2420 and FINRA Rules 2010 and 2040.
