Flow Traders U.S. LLC – In the News:

FINRA v. Flow Traders U.S. LLC (Case #2019064856101) – From at least August 2019 through April 2023, Flow Traders failed to establish, document, and maintain financial risk management controls and supervisory procedures reasonably designed to prevent the entry of orders that exceed appropriate pre-set capital thresholds in the aggregate for the firm and to prevent the entry of erroneous orders. Specifically, Flow Traders set thresholds that failed to meaningfully limit the financial exposure generated from the firm’s trading activity. As a result, Flow Traders violated the Securities Exchange Act of 1934 § 15(c)(3), Exchange Act Rules 15c3-5(b), (c)(1)(i), and (c)(1)(ii), and FINRA Rules 3110 and 2010.

FINRA v. Flow Traders U.S. LLC (Case #2015044231502) – In Matter No. 20150442315, the Trading and Financial Compliance Examinations staff (the “staff”) within the Department of Market Regulation reviewed trading activity of the firm for compliance with various regulatory requirements for trade dates of August 17 and 18, 2015 in connection with its 2015 cycle examination of the firm. The staff’s review resulted in the identification of violations of FINRA Rule 7450. As a result of this review, it was determined that certain of these violations were greater in scope and duration, and not limited to the trade dates originally examined by staff, as referenced herein.
